I have returned today from india
The immigration at DTW airport gave me a tough time
They were not happy about the fact that i Canadian green card
They advice me to surrened it and said it does not satisfy the US and does not not convince them that a person is trying to adjust status and holding a canadian green card
He said he made notes and will keep an eye on my case and adviced me 2nd time to surrender the card and keep paperwork for proof to prove the US authorities
I Have travelled at least 6 times on Advance parole and always had Canadian Immigration stamp on my passport (i have not travelled to canada after getting my Pr card in Oct 2008)

what are the security checks involved with the green card process, and when do they come up?
up sometimes during 140 stage(security). But 100% during 485 stage.
The check I know is called "Name Check" done at 485 stage.

Hello gang! I have a quick question! Has anyone had issues with the prevailing wage being too low? The attorneys requested the prevailing wage from the SWA and it came back really high twice, so they then submitted a private wage survey that my company conducted with a reputable firm and it was rejected. The attorneys have said that they will now appeal the case directly to DOL. Has anyone had to go through this? If so, how long does appealing to DOL take? And, any info on success rate with the appeals to DOL?
Any info would be extremely appreciated! Thanks in advance guys!! :)

Hi,
I'm currently on my amlost 6th year of my H1B. I have my i-140 (Still valid) approved from my previous employer under EB3. I'm applying for a new PERM with my current employer and I would want to apply in EB2. I hold 3ys bachelor's degree with 12 yrs of experience. My attorney says that chances are either my PERM or I-140 will be denied based on my education qualification.
I'm looking for your advice on the following.
1) I heard that I can apply for 3yr extn based on my previous I-140. Considering that is it worth the fight on EB2. I'm looking to port my PD (Nov 2008) to this I140 if approved.
2) My company sponsers two PERM to be applied, so it is worth to try for EB2 and later if denied on EB3. Will this affect my H1B extensions? say if it's get rejected on EB2, am I not eligible to apply for H1B extension with my current employer, since my labor/i-140 is denied.
Please help. I'm just not able to get this over my head :(

I am currently on F1 and will be graduating in December 2007. In August filed I485/EAD/AP through spouse. Now I am planning to change my status from F1 to H4 to maintain the status till I485 is approved.
1. I want to know will my COS from F1 to H4 affect my 485 application as I haven�t received the receipt notice yet.
2. Should I apply for H4 right away or wait until I receive I485 receipt notice and EAD card?
3. How long does it take to get H4 approval?
4. How long, before I graduate should I apply for H4?
5. Is it a good idea to change to H4?

hi
we are paying social security and medicare taxes where as we are not entitle to any of this benefits. they are taking this taxes based on giving permanent status but they have slowed green card processing near to impossible. that's fine, but taking social security taxes is not right when we are certainly not going to part of that system.
they must stop those taxes till green card is processed.

My Lawyer also suggested that we apply Porting PD after the second I 140 gets approved instead of doing it at the time of applying for second I 140.

NSC must have used up all the FY2007 visas...if not and they did not work on the last day of FY2007, then we can conclude that they really don't care if visas are wasted or not.
Do not expect any approval from NSC today....we can only expect automatic uptdates!

I have read in the popular immigration forums that one can request a one time 3 year extension to H1b beyond the standard 6 year limit if one has an approved I140 and could not file I485 due to retrogression. I am confused on how does one go about requesting this..meaning is it sufficient to just put three years under the 'date of intended employment' in I129 form and have a labor condition approval with similar dates or do you have to include a copy of approved I140 and point to the 2005 Aytes memo that grants such a provision while you file for I129. By the way the situation is also a bit more complicated due to the fact that I am changing jobs (5th year H1) and trying to get a 3 year transfer based on approval from the company I am leaving.

NO My husband has applied for I-485 and EAD card for both of us, He is on 9th year, i just got my H1 on Oct 2005.
