My 485 is pending and and I am still working on h1. I have EAD and advance parole, but do not want to use parole to go to canada (Wanted to save it for India trip). Do I have to take canadian visa to travel to canada for 3 days based on my currnet status. what is the process to take the visa?

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.

My wife will be applying for H4 visa (1 st time) some time in march. I am currently working on H1B in US.
while checking the website for documents required for H4, they ask for the Photocopy of the Principal Applicant�s valid visa.
Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
I would appreciate if you could reply me on this regard.

I need to apply for AP.
I am in I-485 pending status. Could some one give clarification for the following questions on I-131 doc.
Part I. Information about you
3. Class of admission (is this correct?)
Ex: H1B/H4
Part 3. Processing Information
4. Have you ever been issued a reentry pertmit or Refugee Travel document?
I am in AOS status(I-485 pending). I got twice Travel Document (AP) approved so for.
There is no mention of AP in this question. what should I answer for this question.
I am also applying AP for my family members. Do I need file G-28 for my family members(Is it only for Attorney representation)

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. I am planning to go for visa stamping soon. This will be by 7th year extension. I have the following questions. Thanks for reading my post and for replies.
1) Recently my title changed from "member of technical staff" to "senior member of technical staff" and I got a pay increase. But the job duties is the same. I don't think this needs H1 amendment. Does it ? I also hope that this will not affect the green card processing.
2) This may be a dumb question. I have the approved I-797 but the online status still shows as pending. Since I know at least one USCIS database is not updated, is there a reason to suspect PIMS delay when I go for stamping ? I am planing to go for stamping in Chennai, I assume there is no way to check beforehand. Did anyone else experience the same (online status not updated) and face any delays due to PIMS.

I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or

As long as your company is generating Paystubs you are not outofstatus. but if there is an audit and if INS finds that you have not paid then its will be an problem.

I was selected in H1b lottery last year however my petition was sent back to DSH for revocation.
I emailed US embassy in Pakistan a couple of time however did not receive any response from them as yet on my case status. So my petition has been returned to DSH but H1b visa has not been rejected yet.
Now another company is offering me a job. My question is that can I use my previous petition and my new employer can apply for H1b without applying for the H1B lottery again. This will be switching employer before H1b Visa approval OR is it that I will have to wait until some decision is taken on my returned petition to DSH?
Any suggestions will be much appreciated!!
