That is not true, my lawyer who is very influential and he has some good contacts he told me that this year spill-over would be different form last year. I was stupid so didn�t believe him about July 2007, and paying it for now for not having EAD.
I know this is hard to believe especially if something comes from lawyer.
Looks like MDix is making fun of EB3-I bcoz current law doesn't allow any spillover for EB3-I category. Damn you MDix.

I don't think EB3-I would be U for more than a month, as I keep saying this year EB3 would be getting some share of spill-over. So even if it becomes U for April that would be temporarily and it would return back in May.

SUBJECT : Authorizations for Employment CASES
Effective Monday July 2, 2007 there will be no further authorizations in response to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation have been made available. Employment preference numbers will once again be available to these chargeability areas beginning October 1, 2007, under the FY-2008 annual numerical limitation.
The above action is a direct result of the sudden backlog reduction efforts of CIS offices during June and the first few days of July. During this short time period over 60,000 requests have been received and authorized. This is in comparison to the 66,425 CIS requests which were authorized during the first eight months of the fiscal year.
Please be sure that this information is passed to all personnel involved in the process of obtaining visa authorizations from the Visa Office for Section 245 cases

Thanks to the glorious service of the Atlanta center :mad: I missed the I-485 bus by 7 days( Labor cleared on Aug end ). Many people with later PD's got cleared from the Chicago PERM center . Now I just watch as all members get their EAD's and AP's while I wait with nothing but hope and watch legislation after legislation fail in the senate and house , and the letters flying all over the place .
Very SAD to know that you missed the opportunity to file AOS by 7 days. I know how painful it can be.
Do you know of any efforts to speed up the ATL PERM processing ? I see the graph at has a downward trend lately (less average time for approval).

Spoke to Congresswoman Office personnel in CA . Congresswoman Eshoo office staff and Congresswoman Lofgren office staff. Going to contact Senator Clinton. I had contributed towards her Presidential Campaign.
Going to meet Congress Congresswoman Eshoo staff next week.
If you are not aware of campaign finance laws , get in touch with them and make em aware of the mistake you made and you should get your check back if you are not a citizen or PR.

You have gotten a lot of feedback already here, just some additional practical advice-
1. You need to decide whether you will be happy comprising for the rest of your life just so that you can protect your baby' life? Make a decision thinking long term if you think your marriage will work or not.
2. As long as you are in the US - be sure you are aware of the legal laws and don't do anything that will go against you (harrassment, abuse, etc). Allegations can be made but do not do anything in anger/frustration that acts as evidence against you in the future.
3. Make sure your wife DOES NOT TAKE THE CHILD AND LEAVE THE COUNTRY UNDER THE PRETEXT OF A VACATION. Cause if that happens then you will be blackmailed for your child and my advise would be to not travel to India under any circumstance since laws there are totally against the MEN.
3. If you decide to go for a divorce, find a good lawyer and get all the information. Do it in the US - laws in India will be in your wife's favor.
4. In general do not travel to India until you are assured that these issues are settled and you won't get stuck in India even if you go there only for a vacation.
5. Record conversations and build proof incase things go bad in the future. Do not take this lightly - this will be your only savior if false allegations are put against you in India.

Here is my story:
I came to US in 2002 and completed masters and been working since then. I got married couple of years ago. Whatever the monetary gifts the girls parents gave as part of the marriage, I put all that in an account on the girls name within 2 days of the marriage. We came to India and from then on the problems started. She and her parents want me to separate from my parents and support their family by sending money to their parents which I couldn't do. How can I leave my parents in their old age when they worked very hard to give a decent life. She has been harassing me mentally for this all the time. Recently her parents have been threatening me saying they will file dowry case in India if I don't send money or cut myself off from my parents. I provided for the girl in all possible ways, even encouraged her to join school to get a masters degree which she stopped soon. We had a baby recently and my parents visited us to help us with the baby. She started harassing them too by saying something or other.
I am very frustrated at this situation and I don't know what to do. I am on H1B and applied for 485 too. At times I feel like applying for divorce but when I think about my little baby I am not able to take that step. The house we currently live in, I bought long before the marriage. It came to a situation where we cannot live together. I cannot ask her to go out of the house because she doesn't have anywhere to go and with the baby even if she leaves, it will be very tough. I talked to my lawyer and she didn't mention about any kind of delay so can you please give me some more details about this PIM and how does it affect the whole process and slow things down.

scorion PIM process is a new additional step that is now part of visa stamping process. if you read around here you will find out more about it but in short uscis office in kentucy has to scan and upload all your supporting documents i.e employement letter etc that you might have used to get an H1 approval. The embassy you will visit for visa stamping has to review all the uploaded doc's before stamping your visa. Now I read in one of the thread here that someone in chennai has been stuck for over 3 to 4 weeks after their visa intvw just because the PIM process is not done. Hope this helps. I dont want another flurry of emails by explaining no-nonsense "conspiracy theory" behind all this (Hint - The day CIR failed , AILF came up with this 95%-98% truth in their websites and the day 2nd CIR resurrection attempt was being discussed is June 13th which is the July Bulletin release Date)
Our only option is to expose USCIS wrongdoings ( I mean all Kind of Wrongdoings ) via Media and at the end of the day show your GUTS to support AILA lawsuit by providing our real names etc... ( incase they need)

Looks like they are changing the spillover rules again from Horizontal to Vertical this is bad news for EB2 I
Because the spillover projection is given only for EB2(China and India). This is due to fact that only EB2-Row is current due to which there is a possbility of spillover which flows to China and India and not to EB3-Row(if it was vertical).

I have pending 485, used Bank of America for my home loan. No problems whatsoever. And, I know loads of people who have bought homes while on H1B or pending 140/485. I believe 2009-2011 will probably be the best time to buy a home. If you can afford it and if you have job security, then you must buy one (rent it if you dont want to live). The aprs available currently is unbelievable (of course, good credit history and the amount you put down will decide mainly).
Did you have unexpired H1B / I-94? In my case I am on EAD / pending I-485 / AOS (expired H1 / I-94) & BOA didn't approve.

I am an H1B holder.... my wife holds an H4. Her DL expired and it has been impossible to get her a renewal. On our last discussion it was brought to our attention that their could be a discrepancy between DHS data (my wife's birthday) even it shows correct in all documents printed by them and the Indiana's BMV database. Meanwhile she is holding 'Temporarily Driving Permits' (piece of paper) that expires every 30 days....

I am for it ( without diluting our present progress).
In fact it is the real date which makes sense & also provides relief to all H1-B new or old. New guys can peacefully change their jobs till their PD becomes current & do not get screwed by employers
