    Hi, my husband was killed in a road accident. He was on J1 and had very good publications and this happened when we were just wanting to apply for our green card, as he had very good credentials we would have got it without any problems. We had dreams of sending our daughter to best school for her college. Now with life turning upside down, I am enrolled in grad school to work on my phd and will take a while, but with this tragedy being recent dont really know how long its going to take to complete it and how future would be.
    I want to know if there is any possibility that I can apply for immigrant visa on humanitarian grounds as it would be very difficult for me to live in India my home country due to social reasons as a widow with a little daughter.

    Friends,


    I need a clarification on EAD card usage. If your spouse whio has an independent H1B visa and whose 485 and EAD application is dependent on you, changes the work status from H1B to EAD, then does the status of the primary applicant also change to EAD automatically. Since the spouse's application was not independent filed and was a dependent on the original applicant for both 485 and EAD applications. I want make sure that the primary applicant's status ( separate independent H1B ) is not changed from H1B to EAD, just because of the spouse starting to use the EAD ( who is a dependent filer on primary applicant for both AOS and EAD ). Would appreciate your inputs.

    we are on last stage approved i-130 USA citizen for married daughter.
    because we overstayed in USA since 1996 here do we have to leave country since we applied only in 2003?
    this would be a disaster since we have nobody in Italy that con support us until get a waiver from USA counsolate....they said about 9 months if everything is ok...
    my only hope is that a read something about cancellation of deportation and adjustment of status here in USA no needed to leave country...how dangerous can be to start this process, wile waiting for last stage of i-130?
    i have good business, house, cars, furniture here and always paid taxes. 2 USA kids. thanks gimme hope

    Hi

    I am on H1B visa and married to a mexican citizen for past 2 years. we both have been living in mexico for past 2 years ( i am working as an Expat). 4 years ago my wife was in US on a Tourist visa and attended community school to learn English. she left the country in 6 months but while re-entering she mentioned her going to school to the agent upon which they processed a expedited removal and put a 5 year ban. She will complete her 5 years in Feb 2012. We are going to have a baby soon and would like to move to US next year after her 5 years are complete. i want to apply for a H4 visa for my wife and my baby. Will her expedited removal cause a problem with H4 application? thanks in advance.

    Hi Gurus,

    I am in my 9th year H1-B. I have my I-140 approved and I-485 pending since July 2007 through employer A (EB-3).

    Employer B is willing to hire me on H1-B (transfer) using AC21 portability (and similarity of jobs). After the move, employer A will revoke my I-140 for sure.

    Can I apply for an H1-B transfer with employer C after a year or two using AC21 portability? I do not want to use EAD. I want to use H1-B tansfer (3 year extensions)?

    This is a major decision that I have to make.

    Please reply at your earliest convenience.

    yes. Select it, then check out the left hand panel. I believe that "layout" will have a check box which says, "show object" or something similar. This is what you use to make an object transparent.

    This will only work on peices of a grouped object... not the whole group.. keep this in mind.

Think Progress explains in a piece refuting erroneous reporting on Lou Dobbs show (surprised?). When you hear figures like 97% of people will be covered under the broadest plans, the 3% they're talking about leaving out are undocumented immigrants.

    Hi,

    I see a LOT of the same questions being posted over and over again. (eg. H1b Transfer, Eb3 to Eb2 etc). I also see that the Questions answered by the lawyer are quite hard to access and the info about the next call etc is also quite hard to get to.

    How about we bring the 2 worlds together. We have a Menu Item on the Left saying either "FAQ's about immigration" or "Q/A from lawyers" etc. and somewhere on the homepage plus in the forums section we put some text saying "Before posting please check out the answers from lawyers" and put a link to the same.

    Along with that (if possible), we also put all the questions and how many have been answered and which ones are going to be answered.

    Rep. Jerry Nadler was the only lawmaker at a meeting of all House Democrats on Thursday to stand up and declare that he could not support a compromise plan to fund the Iraq war with a timeline to end the conflict. So some party leaders had written him off even as he joined House Speaker Nancy Pelosi for a private meeting.

    In the confines of the speaker's suite, Nadler (N.Y.) could be specific. He sought assurances from Pelosi (Calif.) that President Bush would be compelled to withdraw all troops from combat by August 2008, as the legislation proposed. He wanted to know: "What is the legal compulsion to follow this timeline?"

    A Pelosi aide disappeared from the meeting for a few minutes and returned with a few lines of legislative text offering what Nadler wanted to hear: Once troops are out of Iraq, no money would be available to put them back in, outside the narrow exceptions of targeted counterterrorism operations, embassy protection and efforts to train Iraqis.

    "You know," Nadler said after a pause, "I think that's okay."

    Nadler's conversion was a sign of the member-by-member, slow but deliberate headway Democratic leaders say they are making in their efforts to cobble together the 218 supporters they need to pass one of the most consequential pieces of defense legislation in decades, a $105 billion war-funding bill that would impose strict standards of rest and readiness for the military, establish clear benchmarks for the government of Iraq and set a timeline to end U.S. involvement in the war.

    Through closed-door meetings, pep rallies, private phone conversations and horse trading, Democratic leaders are moving outward from the 180 solid votes in the party's political center to win the votes on the party's left and right that will be needed to pass the bill later this month.

    The cajoling will continue tomorrow as lawmakers return to Washington and the legislation is readied for markup later in the week. But there are roadblocks: Rep. Allen Boyd (D-Fla.) said some conservatives are withholding their support until the language McDermott wanted is removed.

    As Democratic leaders balance those demands, the calculus is fairly straightforward, said one conservative Democrat involved in the process. Leaders are counting on winning all but a dozen of the 43 conservative Blue Dog Democrats and all but a dozen of the 75 or so members of the liberal Out of Iraq Caucus. Then, Democratic leaders are hoping, enough Republicans will break ranks to put them over the top.

    By last week's end, House Democratic Caucus Chairman Rahm Emanuel (Ill.) said, they had secured about 200 votes.

    But the last 18 votes will not be easy. That point was brought home Thursday morning, during the closed-door meeting in which the legislation was detailed for Democratic members. As Pelosi gave her pitch, Reps. Lynn Woolsey (Calif.), Barbara Lee (Calif.), Lloyd Doggett (Tex.) and Nadler stood up to leave for a news conference of their own. After an uncomfortable pause, Pelosi growled that she wished Democrats would be courteous enough to hear her out before talking to the media. Nadler sat down. The rest walked out.

    Democratic aides concede that some party members, including Woolsey, Lee and Doggett, are all but lost. But they are not giving up.

    "There's nothing guaranteed in life, but I feel very good," Emanuel said.

    All,

    I'm a EB2 filer and PD is 2003. We did a concurrent filing on Jul 2nd, received receipt notices for the same, FP Completed and EAD approved.

    I see the A NUMBER printed on my 140 and 485 receipt notices. I wanted to understand whether the 'A' number mentioned on the receipt notices is the VISA number or, the VISA number is something different that gets assigned during the adjudication of I485 based on the availability.

    Trying to assess the impact of EB2 retrogression on cases that are already filed and Finger printing is complete.

    Please Advise.

The article is interesting, but what is really striking is the tone of the comments to the online article. There is a display of real anger at Google's hiring of foreign workers in this time of economic hardship - when so many U.S. citizens are looking for work. Read the article. What's your opinion?

    I am currently on H1 and it is with company A. I have an offer with company B and want to get my H1 transferred to company B. I have not gotten my H1 stamped since i have received my work authorization. Can i still get my H1 transferred or do i need to get it stamped and only then can i have my H1 transferred.

    Dear All:

    My wife who is on currently in the US on H4 has recently received her H1B approval. Her H1B is valid from 01-Oct-2007 to 23-Sept-2010.

    When we applied for the AOS in July 2007, we mentioned that my wife's current status was H4 (which I am thinking is still true as her H1B starts only on October 2007). My question is will this create an issue when USCIS is adjudicating our AOS applications.

    Any information on this issue would be appreciated.

    Hi Guys,
    My sis recently changed her status successfully from B1 to H1. After the approval however (within 10-20 days), we saw soft LUDs on her previous H1 petitions (they were both with the same employer). The status hasn't changed however.

    Has anyone experienced such a case?

    One more thing - she had done her AR-11 address change online about a month ago. Could that have triggered these soft LUDs? If so, will they even go and change the address on petitions approved in the past?

    Any inputs appreciated. Thanks.

    October is usually a month where we see improvements as new visa numbers become available for a new fiscal year. Most categories showed forward movement though few jumps of more than a few months. The exception is the Mexico Family 1st category which jumps a year and a half. EB-3 is available again, but not set at a date particularly close. Most people will not be happy with the dates.     Seems there are so many issues for us to face on the journey to live the American Dream. I wonder how many members have been affected

    Death of a petitioner, Step children of USC and H1B children aging out, E 2 children having no status upon reaching 21 years. And the lack of a retirement visa for our parents (usually elderly) to move to the USA, retrogression amongst other issues like delays errors

    I was working for company A in US till June 2008. I had to return to India in July 2008 due to personal reasons. My 6th yr on H1b expired in October 2008.

    I am now in India and applying for 3yrs H1b extension based on my approved I140 with company B. My I485 was filed in august 2007. I do not have US pay stubs since July 2008 as I did not work in US.

    Has anybody been in a similar situation? What are the chances of getting approval? Once I get I797 approval, should I expect further challenges in getting visa stamped in India?

    Hello Everybody. I am new to IV. Recently I have filed my wife's I-485 (06/28) after my I-485 approval on 06/18. My lawyer said that he has filed it by using the "Follow to join" benefits. He is saying that he cannot guarantee that USCIS will accept the I-485 since my I-485 is already approved. He said that we just have to wait and see until the receipt notice is issued.

    Is anybody else in similar situation? Also does any one know what kind of documentation and cover letter needs to be included for this kind of case? I have asked him if he has included the I-485 approval notice and he said "No".

    A few readers have posted links already to a statement made by President Obama at the North American leaders summit that immigration reform is a priority for early 2010. Some see that as a retreat from efforts to move the bill this year. But 2009 was not really realistic anyway not because the votes aren't there but because there is a very practical logistical problem of getting a bill done in just four months.     Hi,

    Thanks for my previous response. I am on H1B and between projects. I have an offer to work for a couple of days for a company other than the one holding my H1B. They said they are not gonna report to the IRS as its an hourly job for 2 days and the number of hours are not going to accumulate enough for the IRS. But they need my SSN or tax-payer ID to run their payroll. I am gonna receive my dues as a simple check (like a rebate check with just the total amount showing up & NOT a paystub). Please let me know if I can work for them or not.

    When you travel on AP carry both the copies. On the PoE the IO will keep one and give the second to you after it is stamped. You use the returned/stamped Copy for your future travel

    When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

    Senate Comity Slips Away (http://www.rollcall.com/issues/53_9/news/19453-1.html) By Emily Pierce and Erin P. Billings, ROLL CALL STAFF, July 19, 2007

    Though tensions between Democrats and Republicans have been festering since the beginning of the 110th Congress, this week�s Senate debate on the Iraq War has pushed the chamber to a new level of partisan acrimony, where even the most seasoned and collegial of Senate elders have abandoned traditional acts of decorum.

    �The Senate is spiraling into the ground to a degree that I have never seen before, and I�ve been here a long time,� Minority Whip Trent Lott (R-Miss.) said. �All modicum of courtesy has gone out the window.�

    That statement came after a highly charged, all-night debate on a Democratic amendment to refocus the U.S. mission in Iraq and complete a troop drawdown by April 30, 2008. The amendment failed, 52-47, to get the 60 votes necessary to overcome a filibuster, and Majority Leader Harry Reid (D-Nev.) cited the Republicans� �obstructionist� tactics in his decision to scrap the entire debate on the Defense Department authorization bill.

    Reid�s insistence not only on having repeated votes this year on pulling out of Iraq but also on having the overnight session contributed to the explosion of partisan tensions, some Senators said.

    �I do think 36 hours with no sleep and the orchestration of a repeat debate of what we just got through two months ago weighed heavily on everybody,� Sen. Johnny Isakson (R-Ga.) said. �It was what it was, but there�s a lot of frustration. It�s a good time for a four-week break.�

    Senate Republicans said the clearest evidence that the chamber�s traditional comity has evaporated is in Reid�s repeated decisions to prohibit GOP Senators from giving short speeches when they object to his unanimous consent requests. Reid first began using the tactic against a handful of GOP conservatives during last month�s bitterly fought immigration reform debate.

    Sen. Arlen Specter (R-Pa.), the most recent victim of that tactic, gave an indignant speech on the floor Wednesday to protest what he said was Reid�s lack of respect for fellow Senators.

    Though Specter acknowledged that Senate rules do not afford lawmakers the right to give speeches following unanimous consent requests, the veteran Pennsylvania moderate said, �It has been common practice in this body to allow a Senator who reserves the right to object to make a statement as to why the objection is being lodged.�

    Specter went on to ominously state that Reid�s insistence on the rules could come back to haunt him.

    �Those practices I think are not only rude, but dictatorial,� he said. �And if those technical rules are applied � and any one of us can do it � this body will cease to function.�

    Republican sources said that beyond Specter, both Lott and Minority Leader Mitch McConnell (Ky.) were taken aback this week when they were denied recognition typically afforded the minority. Lott and Specter � Senators who often work with Reid and Democrats on the floor and on legislation � were particularly incensed with what they viewed as Reid�s disregard of Senate decorum and protocol.

    Specter said that Lott declined Reid�s offer to publicly apologize.

    One senior Republican aide said Reid � by refusing to allow GOP Senators the opportunity to answer him when addressed � sent a clear signal to the minority of, �To heck with you, your views don�t matter.�

    �Not only is violating common courtesy unlike him, it�s not conducive to running the Senate in an effective manner,� the aide said of Reid.

    Sen. John McCain (R-Ariz.), who led the GOP debate on the Defense measure, said what occurred over the course of the past two days � and the past two weeks � demonstrated that the �climate here is very bad� and is �part of the whole environment� of the Senate these days. The Iraq War is just one factor contributing to the heightened partisanship in the chamber, McCain added.

    But it isn�t just Republicans who are complaining about the breakdown of the chamber�s otherwise civil atmosphere. Senate Democrats countered that they also have been on the receiving end of what they consider ungracious behavior by their GOP colleagues.

    In what appeared to be a slap at Democrats on Wednesday, McConnell turned his back on Reid and the Democratic side of the chamber while speaking about the Democratic amendment to refocus the U.S. mission in Iraq.

    McConnell spokesman Don Stewart said the Minority Leader was simply addressing his fellow Republicans as he often does when many are gathered in the chamber. More than 70 Senators � roughly half Republicans, half Democrats � were present for the post-vote debate.

    But Senate Democrats have said repeatedly that they are being forced to use heavy-handed tactics because the minority refuses to adhere to the traditional courtesy of allowing the Majority Leader to conduct the bulk of the Senate�s business without first having to file procedural motions to limit debate. Republicans have objected to a little more than half of Reid�s requests to begin debate on both controversial and bipartisan bills, resulting in Reid having to file time-consuming cloture motions to cut off prospective filibusters.

    �Who�s been asking for these cloture votes?� asked an exasperated Majority Whip Dick Durbin (D-Ill.). �Republicans.�

    McConnell has �lost control of his caucus on this matter,� Durbin said of what he believes is McConnell�s inability to convince conservatives in the Republican Conference to pick their battles.

    Reid spokesman Jim Manley declined to comment specifically on why Reid has been prohibiting GOP Senators from making short objection speeches, but he indicated that Democrats need to fight back against the GOP�s blocking strategy.

    �It�s become pretty evident in recent weeks that there�s been a decision by the Republican leadership to block the Senate from doing all but the most routine and noncontroversial legislation,� Manley said.

    Meanwhile, debate on the Defense bill has stopped for the time being, with Reid saying he would bring it back up once it is possible to �pass a Defense authorization bill, but with a deadline dealing with Iraq.�

    For the moment, Democrats have been able to put a lock on the Republicans� procedural objections by bringing up a higher education reconciliation bill that is privileged under the rules and cannot be filibustered. But that measure was taken up only after Republicans blocked Reid from quickly beginning debate on a Homeland Security spending bill.

    Reid has tasked Durbin with negotiating a deal with Lott, McCain and Armed Services Chairman Carl Levin (D-Mich.) on how to resume consideration of the Defense measure.

    However, McCain questioned whether the DOD bill would rear its head again in the next two weeks: �Without a certain level of cooperation it�s almost impossible. It will be difficult to make it out in time, make it out by August. And the fiscal year ends the first of October.�

    California taxpayers need to cover higher fees of private lawyers, who are hired by the state as the Attorney General's Office doesn't have the staff to handle all of the cases internally. In some instances, the state has employed outside counsel at hourly rates that reach $450 even while most of its in-house lawyers earn less than half that. Rates can be much higher, if the suits require private attorneys having a particular expertise.

    Since January 2008, the Department of Corrections and Rehabilitation has signed about $24 million in contracts with private lawyers hired because the Attorney General's Office says it's too shorthanded to take the jobs. The corrections department is seeking the additional help despite having about 80 lawyers of its own to handle a gamut of cases, with about a dozen of those assigned to prisoner-filed litigation.

    Yesterday I called Senator Cornyn's office to know about Skil bill. The immigration person told me to check back with him after at least one month. He had no word on Skil bill to share with me at that time.
