I had filled my & my wife's 485 on July 16th 2007. However I noticed that the check that I had sent for my 485 had a minor overwriting in the amount field. I had filed for my wife's H-4 extension last month with a similar issue in the check and the USCIS has sent the H-4 application back. Obviously, I do not want the 485 application to be rejected. So i need urgent help on this matter from you all immigration experts, please help me weigh my options:
1.) Can I refile 485 for me and my wife? Is it possible to have 2 485 applications for a person.
2.) If I refile, and then the USCIS accepts my first application, then will loose the fees for second application or will it be refunded?
3.) Do you think I will simply be asked for another check if I dont refile (which I really doubt.)
I know the mistake might sound stupid but Please guide me in this dilemma. Any help will be greatly appreciated.
thanks.

Hi,
I need some clarification. One of my friend confued me.
My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
As per her there is no issue as she will file my EAD/AP after I come back.
Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?
Please advice.
Thanks in advance.

I have B1 visa and and right now I am in US on client support.
I want to get into a College for further studies for which I am unaware of the legal formalities to be completed.
I already have a letter of internship with a US company and the college is giving me a letter for change of status i-20.
As far as the immigration goes for change of status of visa, it says that I need to go out of the country and then come back, with stamped as 'intent to study'. So is it really required?
However still it is confusing for me as to what other formalities are to be completed regarding the same.

Perm applied in May 2007 . Got audit in June . Responded within a week. No response since then. Company lawyer approached DOL 3 times checking for the labor status. No response.
Is it possible to resubmit the perm application retaining old date. Any suggestion if that might help.

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

A year ago, Rahm Emmanuel tried to convince President Obama not to pursue health care legislation. It would be too divisive. Now he's making the same case on immigration and it is upsetting many pro-immigration Democrats. The problem is that President Obama was elected as an agent for change, not simply to be a status quo President who would mind the store until someone bolder comes along. I've been impressed that President Obama has indicated he would be content to be a one term President if that meant he could leave with major accomplishments under his belt. Let's hope his...

Hi there.....Even I want to find out if I-131 (AP) can be RENEWED without paying the fee when I-485 has been filed with the new fee structure. The USCIS site has not mentioned anything regarding the renewal fee for I-131 in this case (whereas it is clearly mentioned for the EAD). Is there anyone who can share his/her experience of AP renewal without paying the fee?

Hi,
I had a question regarding employment in OPT STEM extension. I recently(one week back) got a job and joined as a independent contractor(adding me as a vendor to company and at the time of joining they asked me to fill W-9 form) in company. I was joined first and thought of ask them to enroll in E-verify later.
But couple of days back when I ask the HR for company to enroll in E-Verify in order to update to school officials. HR refuses to enroll because as I was working as an independent contractor and not coming under their payroll.
Regarding how do I get paid? They will pay me bi-weekly. But I need to rise the invoice and submit time sheet and give it to them so that they will pay me a payable check.
And even I got approved OPT STEM extension couple of days back which I was applied through my previous employer.
Is there a way to come out of this situation?
Even thinking of adding a consulting firm layer in between the company and me but I don't want to do that. Please help me out.

Senators Schumer and Graham presented a three page outline of their reform proposal when they met earlier this week. The Los Angeles Times gave a few hints in an article that appeared yesterday: Although details of their blueprint were not released, Graham said the elements included tougher border security, a program to admit temporary immigrant workers and a biometric Social Security card that would prevent people here illegally from getting jobs. Graham also said the proposal included "a rational plan to deal with the millions of illegal immigrants already in the United States." He did not elaborate on what the...

Hi Everyone,
The A# that is listed on my I-485 receipt notice is different from the one listed on my approved I-140. In addition, the number listed on my I-485 receipt notice has only 8 digits instead of 9. From reading various forums, I've heard both sides of the story...some are saying that something like this needs to be corrected, and some others are saying that the A# is just a file number, and eventually gets consolidated.
I called USCIS customer service, but they weren't much help as they couldn't pull up the information in their system.
Any inputs? I'm planning on inquiring about this when I go for fingerprinting. Also curious to know if anyone's A# on their approved I-140 has nine digits, and if the one on the I-485 receipt notice only has 8 digits.
Thanks.
