Refugees from Sudan have a tough time with USCIS, let alone people from other nations. Refugees from Sudan have a tough time. Period. It is sad, and we should do what we can to help those less fortunate than us. Again, period. No ifs and buts about it. But is this the right forum, or even the right website?
There is plenty of clutter on these forums.. (And frustratingly, it has spiked a lot in the last week or so). Please do not add to it.

Rep. Jerry Nadler was the only lawmaker at a meeting of all House Democrats on Thursday to stand up and declare that he could not support a compromise plan to fund the Iraq war with a timeline to end the conflict. So some party leaders had written him off even as he joined House Speaker Nancy Pelosi for a private meeting.
In the confines of the speaker's suite, Nadler (N.Y.) could be specific. He sought assurances from Pelosi (Calif.) that President Bush would be compelled to withdraw all troops from combat by August 2008, as the legislation proposed. He wanted to know: "What is the legal compulsion to follow this timeline?"
A Pelosi aide disappeared from the meeting for a few minutes and returned with a few lines of legislative text offering what Nadler wanted to hear: Once troops are out of Iraq, no money would be available to put them back in, outside the narrow exceptions of targeted counterterrorism operations, embassy protection and efforts to train Iraqis.
"You know," Nadler said after a pause, "I think that's okay."
Nadler's conversion was a sign of the member-by-member, slow but deliberate headway Democratic leaders say they are making in their efforts to cobble together the 218 supporters they need to pass one of the most consequential pieces of defense legislation in decades, a $105 billion war-funding bill that would impose strict standards of rest and readiness for the military, establish clear benchmarks for the government of Iraq and set a timeline to end U.S. involvement in the war.
Through closed-door meetings, pep rallies, private phone conversations and horse trading, Democratic leaders are moving outward from the 180 solid votes in the party's political center to win the votes on the party's left and right that will be needed to pass the bill later this month.
The cajoling will continue tomorrow as lawmakers return to Washington and the legislation is readied for markup later in the week. But there are roadblocks: Rep. Allen Boyd (D-Fla.) said some conservatives are withholding their support until the language McDermott wanted is removed.
As Democratic leaders balance those demands, the calculus is fairly straightforward, said one conservative Democrat involved in the process. Leaders are counting on winning all but a dozen of the 43 conservative Blue Dog Democrats and all but a dozen of the 75 or so members of the liberal Out of Iraq Caucus. Then, Democratic leaders are hoping, enough Republicans will break ranks to put them over the top.
By last week's end, House Democratic Caucus Chairman Rahm Emanuel (Ill.) said, they had secured about 200 votes.
But the last 18 votes will not be easy. That point was brought home Thursday morning, during the closed-door meeting in which the legislation was detailed for Democratic members. As Pelosi gave her pitch, Reps. Lynn Woolsey (Calif.), Barbara Lee (Calif.), Lloyd Doggett (Tex.) and Nadler stood up to leave for a news conference of their own. Hi,
I am GC holder & right now I am living out side USA with my husbad whom I am married for more than 8 yrs. I have 2 kids, they are US citizen. I visit my parents (US Citizen) every year to US for couple of months & come back. In past my husband tried for US visitor visa few times but he was denied. Is there any way I can apply for my husnad a non immigrant VISA from US for a visit? As we would not like to migrate to US but just to visit there. Is there any way or I have to apply for him immigrant visa only & wait for 5-7 yrs.?
Please guide.

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

When we file 485 AOS along with EAD & APL, these are three seperate forms, so we get three seperate receipt numbers?

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website. However, when I analyzed their case, it quickly became apparent to me that nothing could be done to help them. It was too late. The man's I-140 (EB1-3) which was submitted in April 2001 had been denied, and his former attorney had advised them to not to appeal, but to have the employer file...

Hello All,
I will be appearing for L1 individual visa extension in chennai in a few days from now.
One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?
Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.
Please advise as it would help me in responding with correct answer. Thanks.

We filed two different I485s. One me as Primary, for which I have not received any receipt which reached on July 17th. Another from my husbands employer, me as beneficiary which reached on Aug 13th. We got receipt and FP Notice for one which was applied through my husband's employer. Confusion is that in my receipt notice the Alien Number is different from what I received on my I140 Approval Notice. Is it of any concern? Finally will my husband be able to get EAD from my application?

October is usually a month where we see improvements as new visa numbers become available for a new fiscal year. Most categories showed forward movement though few jumps of more than a few months. I want to request everyone - Members and non member ( they will have to sign up at IV) to please update the all the information for the tracker.
Please update any communication that you may have had with USCIS, like RFE, Reciept notice and any other information.
This information can be very useful to IV for generating reports and talk to the officials confidently with data and looking at the trends .. say for RFEs or something else.

If you have successfully transfered your PD after your I-140 approval. Please post your experience.
I have seen I-140 threads for a while ..everyone have a opinion ..but none of you have gone through it....its misleading we can quote different websites and USICS documents ..only people who actually transfered PD can share. How they did it. Whats the process. Please respond to this thread only if you have successfully transfered PD after I-140 approval.

My EAD and AP have the wrong birth date and I just noticed it. I have to re-send form I-765 and I-131 with the original EAD and original AP for correction. My case was originally filed in NSC along with 485, but I live in Texas.
But, as per instructions for I-765 and I-131, form should be filed at:
"Service Center with jurisdiction over your residence or Local Office - depending on where your case is pending."
Can someone guide me please ? Where should I file - TSC of NSC ?
