People,
I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

Gone is the happy plan for a frenzy of lawmaking, the "Hundred Hours" of action Speaker Nancy Pelosi promised when the Democrats took the House. The speaker's artful allusion to Franklin D. Roosevelt's "Hundred Days" quickly became an ironic echo. During that first euphoric legislative period, Roosevelt managed to rescue the banking system from disaster, assist bankrupted farmers, rewrite the economics of agriculture and the rules for flailing businesses, bring back beer � you name it. Contemporary leaders can't even act on pressing issues such as agriculture and immigration, not to mention Social Security.
Why can't politicians be Roosevelts today? For an answer, let's look to the middle of 1935, about two years into FDR's New Deal and the equivalent of about now in the election cycle. The federal government was still smaller than the nation's state and local governments combined. Two out of 10 men were unemployed. FDR took the economic emergency as a powerful mandate for further lawmaking. He jumped into the project with all the glee of a boy leaping into a sandbox. The papers reported that he was going to "blast out of committee" yet another round of bills, and blast he did � that year the country's premier labor law, the Wagner Act, was passed, as was Social Security.
At about the same time, Roosevelt slapped together the Rural Electrification Administration, which came on top of the New Deal's large farm subsidies. For construction workers, artists and writers, he created � also in mid-1935 � the Works Progress Administration, which hired the unemployed, including artists, craftsmen and journalists. To appreciate the size of that gift, imagine a contemporary politician responding to a market crash by putting ex-employees of Google on the federal payroll. The president also built on to an already large structure, the Public Works Administration, which funded town halls, grammar schools and swimming pools in 3,000 counties. The money? Roosevelt passed a tax increase that opponents called the "soak the rich" act. It contained an estate tax rate hike that would make John Edwards drool. By 1936, the government took up more than 9% of gross domestic product. For the first peacetime year in U.S. history, Washington had edged past the state and local governments in size to become a larger part of the national economy. (Just a few years earlier, state and local governments had been twice as large as Washington.) FDR had reversed the old crucial ratio of federalism, and Washington has dominated the country ever since.
Those early commitments set a trend of promises. Some of them became what we now call entitlements. Lyndon Johnson in the 1960s layered on governmental commitments with the Great Society. President Bush has heaped on more, with a new entitlement: prescription drugs for seniors. Only a narrow part of the federal budget remains for discretionary spending � the part left over for new ideas. And setting aside the question of whether an individual program is good, bad or simply in need of an overhaul, we've found as a country that old commitments are simply too hard to undo.
This is partly because of the way the political game works. When you seek to take away a benefit from one targeted recipient, he will fight like crazy to keep it � think of the ferocious battles the farm lobby wages over even tiny reductions in agricultural subsidies. Those who gain from reducing the size of the handout, however, are members of the lobbyless general public who will receive only an incremental advantage, maybe the equivalent of a penny or two apiece. So the rest of us don't have the incentive or ability to apply countervailing pressure. Yet that's exactly what we need today: the energy and exhilaration of FDR in his first term.
Today's timidity would have disturbed FDR, who had no trouble knocking down the sandcastles he had made. Early in the 1930s, he created 4 million jobs with the Civilian Works Administration, then uncreated them when he decided the CWA was too close to the English dole. When he tired of Harold Ickes' Public Works Administration, he scaled it back, and finally abolished it in 1941. As for Ickes' Department of the Interior, FDR decided that it was time to revise it into "a real Conservation Department" � a change many would welcome today.
A few leaders since FDR have persuaded Congress to help them bring about changes on this scale � Ronald Reagan's bipartisan tax reform of 1986 and Bill Clinton's welfare reform a decade later come to mind. These presidents were truer to FDR's spirit than the hesitating Congress of today. Clearing some blank space for new institutions is possible. My full 6 years of H-1B expires in Jan 2010. My labor will be filed in Jan 2009. I would like to go back to school full time on F-1 in Fall 09. At that time, I would still have 5 months of H-1B time remaining plus a priority date. After I graduate, find a job on a new OPT, would it be enough time to start a new GC processing, without having to go back home for a year?

Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

Last month dates were 7 Jan 2005.
This month dates are 22 Jan 2005.
Still the reported Jan 2005 approvals(, IV ) etc are less than 5.

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

We are going to India on Vacation in Aug 2008. I am on H1B visa and my daughter (3 yrs) is on H4 (My dependent). My wife came to US as my dependent on H4 visa. But now she is on L1B visa.
Q1: Can I add my wife as a co-applicant while booking the appointment online even though she is not my dependant )so that we can all appear for the interview at the same day and time)? I didn't find any guidelines related to this anywhere.
Q2: We are looking for an appointment on Sep first week. Will the slots for Sept available by Aug 1st week? How many days before I can book the appointment?

i have been offered a job at my current research centre where i worked as a student. I want to go back to my home country. The job can be done online and does not require physical presence in the USA. Will i still need an OPT? or can they employ me as an international worker? if they wmploy me as an international consultant then what are the ramifications for teh company? wht is the legal procedure? will they have to pay taxes more etc?

I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.
My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

To answer you briefly, GC is not something that your company or you can handle by yourself. You definitely need an attorney. There are 3 stages and so many things involved in each stage:eek:. If you get hold of good attorney firm they will have all the templates and will guide you.

i would like to join a very good opportunity on EAD but have one concern shown below.
"a person has a valid ead/ap and he is gone outside the country for some work purpose and uscis denies his 485 in an illegal way like for eg: (denying AOS applications that have been pending more than 180 days when an employer revokes an I-140). how will he enter USA then ??
can he file MTR when he is outside the US with the help of a lawyer ?"

I ahve a one month old newborn. We are planning to go to India for vacation end of July. I have to apply for my baby's US passport. But she has not received her SSN. The instuction says that SSN is not mandatory but IRS can fine you if you dont disclose that information. I tries to contact SSN office, IRS office and Passport Office. Each one will point to the other Agency. So not sure what what to do. Anyone who was in the same boat, please let me know whether there are any issues with applying for passport without SSN number.

I am a US Citizen and just married an immigrant. Her situation is interesting. Upon arrival to the U.S. she was detained and an I275 was filled out but not submitted. Apparently, her visa had been expired due to an overstay in the distant past. The result of the detention was a Paroled status stamped on her pasport. No I-94
We met shortly after her entry and are currently maried. We want to self-file the I485/I130 papers but don't know how to proceed without an I94 number. If we submit an I102 will she get an I94 replacement or will they reduse based upon her Paroled status, whcih she has overstayed?
