The Immigration Bill was rejected :(
But I read that senators are coming up with a new partial bill which is again mainly for illegal immigrants. Don't know whether H1 caps are included or not.

I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.
Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.
Please suggest.

Labor Filed Substitution: 07/2007
Appeal: 11/2009 in process
I calculated my time in USA excluding time spent outside the country and my 6 years will end in June 2010. When my employer renewed H1 back in 2008 he simply claimed for 3 years and USCIS approved till 03/2011. But I read somewhere online that we have to calculate our time spent in the country and should not go by the date that is on our H1.
1. Does the change of status from H1 to F1 reset the H1 time period or do we have to consider that time period while calculating the 6 years
2. As my application (AAO) is pending I heard I will get a one year extension. The question I have is can I stay on my current H1 till 03/2011 or do I have to renew my H1?

Hello Friends,
Now the Fence bill has come and gone, none of our amendments are included in, all by now may have realized we need to keep it up for few more months before we see something happen.
And all those waiting for something to happen may also have realized that they need to contribute $, and I believe they did. (I did.)
I sincerely believe that IV members need also have to do one more SIMPLE ACT. Please spread the word about IV.
I have seen N number of times IV core members & many others, requesting to post the banner of IV in the grocery store you visit to help admit more members.
If you have not done it, please do so. I did it.
Simple things like this will help IV membership grow bigger and better chances of getting something done.

My I-140 cleared on last month, also I applied for 3 year's visa extension, got receipt. Now I want to change company, I got a got offer from a big company. My question is
1. If I'll apply H1-b from new company , how many years visa I'll get(With current I-140)?
2. Is it possible to keep PD of my current GC (Aug'03)? even in case of my current company revoke/use my GC?

I had been in H-1B status and was laid off. My H-1B was withdrawn by my company on 12/31/2010. I applied for COS to B2 and received the USCIS receipt notice on Dec 17th, a few days before my H-1B was withdrawn.
Later on Feb 2nd, 2011, I received the approval notice from USCIS for B2 valid from 02/02/2011 to 04/29/2011(I had informed in my application that this would be my date of departure.) My question is: What status would I be from the date my H-1B was withdrawn till the B2 validity start date?

Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824

Gurus, I am on H-1B visa doing a project with 'abc' client who is the client of 'X' company and pays to my H-1B employer 'Y', I get paid from 'Y'. I started on this project on H-1B visa but now I have EAD(spouse of primary applicant) and want to change my status to EAD. The X company says that they have non compete agreement with Y company(my employer) and can't bring me on board unless I get email from my employer stating they have no objection me moving to EAD. My employer is not ready to give me that email(for obvious reasons.. after all it is a desi employer).
I want to find out if there is a way out..also I never signed any agreement with my employer..in fact I don't even have a copy of offer letter. The only agreement I have is with X company that I can't go back to the same client for one year, the day I end this project. I am based in Boston MA.

Here is my situation and I need URGENT help.
I am currently on L1-A for past 7 years (Visa expires Nov 07). During this span my company's attorney has unsuccessfully filed my I140 (twice was rejected at NSC and later TSC - due to 3 year degree and also my job description prior to transfer to US did not showed I have managerial/management function of a department). He refiled again this time with proper documentation and additional support letters from senior exec from my company.
I suspect he has been making mistakes in my filing and my time is running out. I am thinking of using my own money and hire another lawyer to file a fresh I140/485. Is this possible since I have already 2 pending I140; one at NSC under EB-1C and another at TSC under EB-3?
Please reply urgently if anyone has the answer to my question as I am running out of time.
