Hello All,

I'm in a big fix now, need immediate suggestion and help.

I have a valid H1B petition filed from SC, now I had moved to FL and started working on a prj. I have planned for my trip to india early june and then I came to know from my lawyer that I need to have a new LCA and H1B amendment before traveling to india and appearing for visa interview.

They had already filed for my new LCA which I have got and they had applied for my H1B premium amendment also but I haven't got the new petition yet.
I have applied for the visa interview by filling all the DS-160 forms for my family based on old petition number.

Can I can still go ahead with the interview and carry the new amended petition in my hand OR should I cancel the existing interview and once again fill the new DS-160 forms and take the new interview date ?

Please let me know on this....

I received the excellent news today that the Memphis Youth Symphony Program has landed Bulgarian-born Stilian Kirov as it's new Music Director and Conductor. And since one of my children performs with the MSYP, the news is even better. Kirov is a graduate of the Julliard School of Music and has conducted major orchestras across Europe and the United States. Stilian is also an accomplished pianist. In 2001, he was awarded a gold medal in Paris' Claude Kahn International Piano Competition. We look forward to Maestro Kirov coming down Memphis way.

I am also in same boat. but I havn't filed I-485 yet, and in oct my I-140 got denied.
My EB2 was converted to EB3 while responding to previous query on EB2.
I want to opt only for EB2 cate.

I did not find much information about this subject here. That is the reason for this post.

Any thoughts on transferring from BEC to PERM? I know that some folks in my company who applied recently with PERM got approval in less than a week!

I am wondering if anyone has already tried to transfer from BEC to PERM and what their experience has been?

I know that it is risky as it involves closing the pending case in BEC before opening a new one in PERM. The risk of losing the original PD is very high, especially for those of us with > 6years of H1.

DOL was supposed to get back with more clarification on the subject of transfer after gathering stakeholder comments but have not anything about it from DOL in months.

I am currently in Dallas. For applying a duplicate passport, it is OK if i Mail my application through USPS express mail which provides acknowledment . Can anybody please tell me if there is any problem with this?

My i140 was approved 2 months back and now i got a Full time position in another company.

So my question is, after moving to new company if the dates are made current can i still file for i485 with my old employer if he agrees for it?

Did everybody who filed Jul 2nd at NSC got their reciepts?
seems like TSC is done entering Jul 2nd application as Jul 3rd-5th are getting their reciepts. It makes me wonder as to how the reciepts are issued if Jul 2nd filers are waiting and farther dates got their reciepts. Is it only issuing delay ?

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..

They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.

so should i come to new program..if thats the case how to get an emergency appoitment.

Does any one have any advice about AC21

Is it advisable to file AC21 soon after changing/ joining new employer?

OR

Just keep quite and look for any RFE, if any RFE comes up send AC21 form and updated employer information along with it.

IS there any guidelines from people who already did it successfully

I think you need to reapply for H1 again (unless you are transferring your visa category to H4).

Hi,

I wanted to know that suppose i withdraw my H1 ,
then does it means that my H1 is gone?

And if i want to have H1 again if future (say next year) , will i have to go through the lottery again?
