Opponents of health care reform efforts have accused the President and Democrats in Congress of including millions of illegally present immigrants in proposals to expand health insurance coverage. Whether one thinks that including such individuals is good or bad, the fact is that only lawfully present immigrants will be eligible for inclusion in the various proposals being considered in Congress. Think Progress explains in a piece refuting erroneous reporting on Lou Dobbs show (surprised?). When you hear figures like 97% of people will be covered under the broadest plans, the 3% they're talking about leaving out are undocumented immigrants.

When you have no GC and are on h1 legally...can you go on a cruise..I do not have stamping on the PP ..the cruise goes to some places in the caribean??..is there a immigration check while comming back??..how does this stuff work...OR is it no GC no Cruise??..

In the arcane world of Capitol Hill, where the majority dictates which legislation comes before the House and which dies on a shelf, the ability to offer amendments from the floor is one of the minority's few tools.
Last week, the strong-arming continued during the most important debate the Congress has faced yet -- the discussion about the Iraq war. Democrats initially said they would allow Republicans to propose one alternative to the resolution denouncing a troop buildup but, days later, they thought better of it.
And yet, significant numbers of House Republicans have voted along with Democrats on the legislation passed so far -- a fact that somewhat mutes criticism about iron-fisted tactics.
In the first weeks of the new Congress, however, Democrats bypassed the usual legislative committees, refused to allow any amendments and took their agenda straight to the floor for passage. They said they needed a clear path to pass a handful of popular measures that were the basis of their successful November campaign, including expanded money for stem cell research, an increase in the federal minimum wage and implementation of recommendations of the Sept. 11 commission.
Democrats said they would impose "regular order," the rules that permit the minority to participate more widely, in short order.
But even after passing their domestic agenda, Democratic leaders have continued to marginalize Republicans, preventing them from having a voice in legislation such as a bill to withhold federal pensions from lawmakers convicted of ethics felonies and a $463 billion bill to fund the federal government for the rest of this fiscal year.
Last week's debate on the Iraq war, culminating in its passage Friday by a vote of 246 to 182, was conducted under a "closed rule," which means Republicans could not offer alternatives. "I understand what they did on their agenda," said Rep. Mike Simpson (R-Idaho). "But to do a closed rule on something like this is a huge mistake. We're talking about war and peace. You don't play politics with war."
While they did not allow amendments on the Iraq debate, the Democrats gave every member of the chamber five minutes to speak on the resolution -- an unprecedented amount of debate on a nonbinding resolution, according to Thomas E. Mann, a scholar at Brookings Institution. He said that is more than the Republicans offered Democrats when the GOP passed a resolution last spring supporting the war in Iraq.

My EAD expired in June 2007? I want to get EAD now. Bymistake I discarded my expired ead which is needed for renewal? Should I apply for its renewal or a new one?

As long as you have a valid advance parole, an approved I-140 and a bona fide offer of employment in the same or similar occupation you are not likely to be at risk if you go to India. However, before making a decision to travel, you should consult with an immigration attorney fully familiar with your immigration and employment history.

I am currently attending a college here in China. However, I have been offered some interesting jobs . These jobs require that I have a resident visa. I have been told that I can't change from a student visa to a resident visa, while in mainland China. Is this accurate? If so, is Hong Kong an option for me?

What a piece of work from the man who warned us about death panels in the health care bill. His grasp of the facts don't seem to be much better when it comes to USCIS' enforcement of H-1B rules. From this letter, you would think USCIS is sitting around eating bon bons and not engaged in one of the most serious crackdowns in the H-1B program in decades. Most immigration lawyers who saw this memo today are probably scratching their heads because they've recently gotten requests for evidence asking for exactly the kind of documentation Grassley complains USCIS is not...

I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

I just got my labor cleared. EB3.
I need to get the I140 processed
Any idea how much time it generally takes for this to process.
The reason I'm asking is because my h1 needs to be processed in April and if this I140 gets cleared before that, I can get my h1 extension for 3 years.

Once you file it usually take 1-2 months.But you have premium processing for I140 now,you can have result in two weeks.So don't worry ..just talk to your attorney.

the format of employment date should be "mm/dd/yyyy", or just 'mm/yyyy'?
my last day in my previous employer was a Friday 5/15/2009 and my attorney entered 5/17/2009 (Sunday) as my last day on the LCA coz my first day in my current employer was 5/18/2009.
I am asking my former co-workers to write experience letter for me. Should I let them write '5/15/2009', or '5/17/2009' or just '5/2009' on the letters?

I am on H1-B. I filed I-485, I-131 and I-765 in August 2007 under EB3 (ROW). I got married in Sept 2007 but my wife is still in home country due to J-1 2 year HRR. Her 2 years are up in Jan 15, 2008 and she plans to join me on H4.
1. Does my company or I need to do anything for her to apply for a visa at the consulate? Does she take a copy of my H1-B approval marriage certificate and that's it?
2. When she comes the US at the end of January we plan on filing I-485 for her based on my application pending. Can she file for AP and EAD at the same time? Would she be able to work on EAD if it gets approved?
3. I got a letter in the mail today that I have to appear for biometrics on Nov 07, 2007. Does it mean that after my biometrics are taken my GC could get approved right away, even though EB3-ROW is no longer current?
4. After my I-485 has been pending for 180 days, does it mean I could take a similar job anywhere?
