If her H-4 has not expired she can file now for a change of status from H-4 to H-1, as per the last action rule, her petition filed now will override the earlier request for H-4 extension. If she does not have an unexpired H-4 she can file for COS based on the pending H-4 extension request by including the receipt.

Yes, I have received receipts for 485, EAD and AP for me and my family on 10/3.My case was filed on Aug 14th, received by NSC on aug 15th, Receipt Notice Sept 26th.

i called TSC and after about 10 mins or wait, i was directed to a very nice lady. Who basically told me that they are processing April 30 application adn since mine is august RD, I have about 4 more months before they look at my file. So to answer, they do go by RD and not ND. She also tole me that my name check has been cleared. Its a matter of time now.
I have not seen any updates on my case, since the LUD after FP. I do have a criminal issue, so I anticipate an interview. However, i have forwared all my court docs to them when i applied for 485. some attorneys tell me that interveiw may not even be needed since they have all the court docs. It was for a DWI 8 years ago.

I'm in Spain this week so can't give the full treatment, but thanks to readers who sent this happy news. The US has won the Nobel Prize in medicine for work done by these two scientists as well as Carol Greider. Blackburn is Australian-born and Szostak is British-born. Here is my situation wrt to I 140 and EAD.
1. I am on 6th year of H1 this year and my H1 expires on 30 Sept 2010. I have to apply for H1 extn this year.
2. My employer started GC process (EB3) in 2006 on substitute labor of Aug 2005. He applied I 140 in April 2007.
3. He applied EAD when they are current during June, July 2007 based on substitute labor. I and my wife got EAD eventhough my I 140 is pending.
4. As old I 140 is pending he applied another I 140 with different EB3 labor for me in 2008 and both new labor and I 140 got apporved. He ported my A# of EAD card to this new I 140 showing as beneficiay on it.
5. My old I 140 is still pending and USCIS didnt send any query on that till date. My employer is confident on getting approval of old I 140.
Here are the questions I have:
Can I work on EAD by taking full time jobs by applying AC 21? Does it safe to work on EAD?
If my old I 140 gets any problem what are consequences with my GC process?
Can anybody answer, Please.

its mostly additional security review. A friend of mine was in similar situation, took about 6-8 weeks for him to get a visa.... but unfortunately client wasn't ready to wait that longer.....

My company filed a new PERM application recently. I have a EB3 I-140 approved from my old employer ( Approved in August 2009). My attorney had filed the new PERM and requested to capture the same date. Will this cause any problems? Below is the question that is asked in ETA9089 form.

This is my third EAD renewal. My 485 is pending at NSC. I am in CA. All my previous EADs/APs etc were filed at NSC.
This time when my EAD renewal is filed (by my new attorney, in new company) I got receipt Number starting with MSC.
Who decides where to file MSC? What's the criteria to file at MSC? Shouldn't it be file at NSC?
Is this a mistake?

if your used to the easy layout of cinema 3d (like me) then stick to it cause its alot easyer to use that 3d studio max then when you get more used to 3d design then you should maybe choose to start using 3d studio max.

Hi
My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.
1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.
2 ) Are there any chances of rejection
3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.
4) Can we expect some decision from them this week as client is waiting.
5) At what time CSC updates the case. Is there any particular time they update the case online.

I have a question for the gurus. I have my GC application in process- priority date March 2006, EB2 I. When the application started my wife was on H4.
Now my wife is on H1B, and her employer has asked if she would like to have her GC processing done. Question is that can she get her application started and can I be the beneficiary on her application. The rationale behind this thought process is that considering the economic conditions, is this a safety net that one can use?

I am applying for new H1b in April. Also I have 485 applied under EB2 with I-140 approved.
1. Can anyone tell me what all information about my green card status I need to share with prospective employer attorney to make sure they provide it in H1b application...???
2. What's alien number and where can I find it...???
